Therapist Negligence
Too many children in the child protection system are treated by Master’s level therapists, interns, or even licensed practitioners who do not have the experience to spot the red flags of sexual abuse and other serious psychiatric diagnoses caused by the abuse and traumas they have experienced. At Justice for Kids, we are fighting to hold these organizations accountable for the damages that they cause.
- Two adoptive parents filed negligence claims against a child welfare provider which provided a supported foster home placement for their adoptive child. The therapist for the provider, who was unlicensed, failed to diagnose that the child was sexually abused in care even though he exhibited the classic warning signs of such abuse. After adopting the foster child, the child was sexually aggressive and acted out on their other daughter. This case settled for a confidential amount and placed in trusts to provide therapy and other supports to both children.
